as I said it is in production hell they are negotiating with cbs yo see if they can get it made with cbs blessing. That being said they have the option to make it into an A.U.(like star wars)or to write out any star trek references as actual filming has not started yet. The one thing they are committed to is to complete the film.

i must admit i was a fan of the axanar production so much so that i funded the axanar production on indiegogo. the production is at the moment in production hell at the moment brcause cbs owner of rights has issued guidelines that make any fan film unworkable
